Last Sunday, someone threw at least 10 oil-filled wine bottles on various roads in eastern Bavaria. As a result, a 37-year old rider and father of two lost control on one of these sections. He slid into an oncoming car and died instantly Sad No suspects as of yet.

What are the applicable laws - what will happen to the mis-wired, brain-less criminals (if caught) ?
Will they go to jail - being responsible for the man's death or some lesser criminal offense ?

What are the applicable laws - what will happen to the mis-wired, brain-less criminals (if caught) ?
Will they go to jail - being responsible for the man's death or some lesser criminal offense ?  


I'm not an attorney, so I'm not sure what would happen, but it all depends on whether the perpetrator could be convicted of willful manslaughter. However - if even caught - he'd probably get off with arguing it was a stupid prank gone wrong and end up on probation/doing community work. In Germany, there is also the occasional problem with people throwing stuff (rocks or bricks) down on cars from bridges over the Autobahn, which has also led to loss of life. These culprits are rarely caught.

It sucks that they did since but isn't Markt Rettenbach in Western Bayern not eastern? If my memory is correct (and there isn't more than one in Bayern, then it is south east of Memmingen.  I lived in Auerbach, i.d.Opf for ten years.  You are correct that the perpertrators are seldom caught and many because the Polizei don't pursue them very aggressively. They reason they say is because of a lack of manpower. I know, because I heard that all the time from my ex-wife who works for the Polizei.

Doh! You're of course right, it's western Bavaria. Anyway, the Germans do try and keep their roads in good nick, but it's not always easy. I don't know how often I've seen large cargo straps from sloppy truck drivers lying on the highway. Wouldn't want to run over one of those on a bike.

That's Not a Good Thing....  Not that anyone would ever get caught in the U.S. (sadly)
People have done similar things here.....  a few years ago - I seem to remember someone threw a rock down on a car from a bridge and killed this woman, she had just gotten married and her husband was driving

Ralf, there are always people with far too much time on their hands and empty space between the ears.

Not being the bleeding heart type, in my world, if that person was caught, I'd assign land mine duty to them...I mean send them out on foot into a mine field to find them.
