Topic: Georgia Speeding ticket. Anyone with advice? (Read 2065 times)

Georgia Speeding ticket. Anyone with advice?

OK, I was on I-75 and got hit, you guessed it, Tifton..... I went to pass two trucks and gunned it for a second and got up to 94 then went right back to 75mph... The Sheriff got me doing 94mph... Anyone with experience in fighting or reducing tickets in GA? If so do you know a good attorney? I don't even know how much the ticket is going to be yet, but from reading on line it's looking like around $500!!!

Was it 94 in a 55 or in a 65? ( 39 or 29 over the limit) Do you have the option of paying the fine or is it a mandatory court appearence?
If you have a relatively clean driving record and it is a mandatory court appearence, you may as well go to court and plead your case and hope for a reduction. If you choose this route, I would also employee an attorney. If your driving history is say suspect and you have the ability to pay the fine, then you might as well just pay it and take your lumps.

It was 24 over..... I have never had a ticket on a motorcycle in 24 years of riding... Last ticket was 3 years ago in a car..

That's super speeder territory, which adds $200 to any ticket fine. Doubtful you'll get that reduced. It was instituted as a money maker. If the officer did not reduce the speed at time of ticket, I think your SOL.

They deputy must of had a bad day because he was a dick the whole time. I work with a lot of LE in what I do so I was polite and made sure I did everything to make him feel safe (traffic stops are one of the most dangerous situations for an officer). He even agreed that I only "popped" up to that speed for a moment, but wouldn't give an inch.

Argue that, in order to safely overtake, you had to speed for a very brief period. Would work in the UK.

It still would not hurt to go to court and talk with the officer. Tout your driving record on the bike. Of course if the driving record in a cage is bad then all bets are off. Not sure if you can speak with the prosecutor or not but if you can I'd try that route also. Plea bargaining is always preferable to get everyone out of court as quick as possible.

Your guys' advice sucks.
94 on a limited-use highway in GA qualifies for the Super Speeder violation.
Check and see what county court your summons is for. Then start Googling and find a LOCAL attorney. Call him/her and talk to them. They won't charge you anything for the consultation. They could very well get you OFF the super speeder charge/fine/points.
You will likely have to pay both attorney fees and some fine but it might be the better option than the SS fine, which is very steep and "pointy."

First, At that speed I agree with hiring a local attorney. But remember the LOCAL attorney will not really fight his friends for you. But he may be able to use that friendship to get a lesser speed with some creative "fines".
Second, These tactics have worked: Is the officer currently certified to operate a laser/radar? He must be certified once every year. Is the municipality authorized to operate said equipment on that particular stretch of road? There are several other issues that may get the ticket thrown out of court. This information may be obtained from a Freedom-of-Information request.
Foundation of his case: Georgia Code 40-14-17 (enacted by Ga Legislature on 3/25/99) [16] basically states the device must be an approved unit and the officer must have a certified letter stating such when he presents his evidence in court. He cannot even mention your speed until the foundation has been laid.

May be to late if you have paid, but you should receive letters for legal services. Call each or pick one. It will be worth the money and it could save you a bundle. I live in Ga and they need money. I went to the STAR event in Johnson City TN and got a picture in the mail of my tag along with a think you for visiting TN. Cost $50.00 for a "non moving" speeding ticket in Bluff City Tn. If you are like me, you may have exceeded the speed limit and not received a ticket. So it could be worse.

I have to have a rabbit in front of me before I do more than 5 over, If i got a car or cycle down the road that will take the hit for me I have time to hit the brakes and slow down, other wise I don't speed
