LINCOLN, Neb. (AP) — An American Indian tribe is suing some of the world’s largest beer makers, claiming they knowingly contributed to alcohol-related problems on South Dakota’s Pine Ridge Indian Reservation.

The Oglala Sioux Tribe of South Dakota filed a federal lawsuit Thursday demanding $500 million from five international beer manufacturers for the cost of health care, social services and child rehabilitation caused by chronic alcoholism on the reservation.

The lawsuit also targets four off-site beer stores in Whiteclay, a Nebraska town with a population of about a dozen people on the South Dakota border that sells nearly 5 million cans of beer annually.

The Connecticut-sized reservation has struggled with alcoholism and poverty for generations, despite an alcohol ban since 1832. Pine Ridge legalized alcohol in 1970, but restored the ban two months later.

No leniency for Ill. man in erectile pump case

PROVIDENCE, R.I. -- Prosecutors in Rhode Island are asking a judge to reject a request for leniency from an Illinois man who admitted shipping unwanted penis enlargers to diabetes patients as part of a Medicare fraud scheme.

In court papers filed Thursday, prosecutors say the 1 1/2 year prison sentence sought by 49-year-old Gary Winner, of Wheeling, wouldn't serve justice. Winner is being sentenced Friday.

The guidelines for determining Winner's punishment recommend a prison term between just under six years and a little more than seven years. Prosecutors are asking the judge to impose a sentence on the low end of that range. They say he could face a maximum of 33 years in prison.

Winner pleaded guilty to four charges stemming from the scheme and agreed to forfeit more than $2.2 million.

NEW YORK (Reuters) - After a five-year battle with bureaucracy, a former U.S. Marine finally got New York City to admit on Thursday that he is male and agree to reissue the birth certificate that incorrectly stated otherwise.

David Hassan, a bearded Iraq War veteran, was born in Manhattan's Lenox Hill Hospital 29 years ago. There was never a reason to doubt he was a boy.

But it was only in 2003 that it came to Hassan's attention that the hospital had deemed him to be female on his birth certificate, his lawyer said.

Once the world record holder for the largest breast implants, Hershey suffered from a potentially-fatal infection that formed around her breast implants. She had to have those world record-breaking implants removed during this tough health situation.

Fugates of Kentucky: Skin Bluer than Lake Louise

Benjamin "Benjy" Stacy so frightened maternity doctors with the color of his skin -- "as Blue as Lake Louise" -- that he was rushed just hours after his birth in 1975 to University of Kentucky Medical Center.

As a transfusion was being readied, the baby's grandmother suggested to doctors that he looked like the "blue Fugates of Troublesome Creek." Relatives described the boy's great-grandmother Luna Fugate as "blue all over," and "the bluest woman I ever saw."

In an unusual story that involves both genetics and geography, an entire family from isolated Appalachia was tinged blue. Their ancestral line began six generations earlier with a French orphan, Martin Fugate, who settled in Eastern Kentucky.

Doctors don't see much of the rare blood disorder today, because mountain people have dispersed and the family gene pool is much more diverse.

But the Fugates' story still offers a window into a medical mystery that was solved through modern genetics and the sleuth-like energy of Dr. Madison Cawein III, a hematologist at the University of Kentucky's Lexington Medical Clinic.

Losers need help from valets

That old public service announcement is pretty well ingrained these days: "Friends don't let friends drive drunk." But who else should be responsible for stopping would-be drunken drivers? Bars and restaurants are already legally on the hook. Some in Boston say valet parking attendants should be, too.


He says it only makes sense that valet workers withhold keys from drivers who appear drunk. "They are literally our last line of defense," Consalvo says. "If not them, who? They are the ones with the cars and the keys. I just think it's a no-brainer."

Man arrested for allegedly setting fire to fiancee’s trailer

VALLEY CENTER — A Valley Center man was arrested Friday night on suspicion of setting his fiancee’s trailer on fire while she was inside, and slashing her car tires before fleeing with his mother, sheriff’s officials said.

Marc Thompson, 52, was booked into Vista jail on charges of arson, domestic violence and violation of a restraining order.

According Lt. J.T. Faulkner, the incident began when Thompson and his fiancee, Christina English, 26, got into an argument and fight at the trailer on Spearhead Trail.

Thompson allegedly stormed out, punctured the tires of English’s car with a knife, then went back inside with container of gasoline.

English was still inside as Thompson allegedly poured gas in the trailer by the door and left a trail of gas as he exited. When he was 20 feet away, he ignited the flammable liquid, sheriff's Sgt. Dan Lopez said.

As English jumped through flames to escape the burning trailer, her gasoline-soaked socks caught fire. She managed to pull off the socks and suffered no injury except singed hair on her arms, Lopez said.

Thompson had phoned his 83-year-old mother to pick him up, and when she arrived, the two drove away. The Sheriff's Department was notified of the incident about 5 p.m. Deputy Aaron Boer saw their vehicle about five miles on Valley Center Road and pulled them over. Thompson was arrested, then jailed, Lopez said.

KITCHENER — A plastic toy gun is to blame for the mayhem that saw a man arrested at his daughter’s school this week.

It was found in the home of the Kitchener father of four after he was arrested over a drawing his daughter drew at the school on Wednesday. Jessie Sansone was strip-searched but not charged.
