I ordered a swing arm from JMC over a year ago.  ZERO contact.  Emails go unanswered.  Phone call goes to a full VM box.  The swingarm is paid in full at just about $1k USD.  So I'm seeing if anybody lives near and could poke their head in and see what's going on.

Yeah....I only let it go this long because I understood it would take some time from people who have gotten swing arms from JMC before.

I remember some 20+ years ago I ordered a Powerbronze full fairing for my RZ350 from England. It took forever to arrive. I called several times and they were very apologetic and assured me it would be sent soon. Ultimately, it did arrive, but I think it took 6 months. However, I must say that I was ultimately very satisfied with the quality of the fairing.

TBH... blarting about office of fair trading is useless as you havnt actually paid for it so they still can do nothing about it and it be all "fair".....

Ive heard a lot of good things from them... suprised about the responce

 I had every excuse from his sons leaving the business to waiting for parts and being snowed in on a day I even went to the premises..

I live in the netherlands and the premises look derelict with a big rusty padlock on the front .

I have been to England twice since and both times same derelict place no sign of life !

However from his website It seems he is still trading :mad:.

There seems to have been some breakdown with thids company I would beware .

If anyone has a alternate address for this guy or even a home address i would love to have it .

Trading standards in kirby dont seem all that bothered.

I hear lots of other people complaining too !

JMC have had a history recently of not supplying parts to domestic and european markets. They seem to be making bulk order loads for the US custom scene last I heard.

 

If you like the JMC style of swingarm then it would be worth talking to metmachex as they don't have the same delivery/ ignore the customer issues but produce a similar product.

 

Paying a deposit for a product is entering into a legally binding contract so the OFT are appropriate. You would however have to envoke time of the escence clause to get your money back/ swingarm in a reasonable timeframe.

Set the record straight!

Well, I've had it.  In May of 2009 my wife ordered and purchased a Swingarm from JMC Swingarms in Liverpool, UK, Owner/Operator John McCarten for me for my birthday in September of 09.  They are a well known Swingarm Makers in the UK.  It is now one year later and I still do not have the product we bought and paid for.  I have emailed Mr. John McCarten no less than 12 times not including the original order.  His website quotes 15 week for delivery.  Needless to say, he is well past this deadline and far past my patience limit.  This swingarm cost me $800.00.  My last email specifically requested a time frame for delivery.  He has yet to contact me.  I also stated, if he was unable to let me know when it was to be delivered, I wanted my credit card refunded.  He has not complied with this request either.  I can on believe that he is a thief and has frauded my wife and I out of $800.00.  I'm attempting to file a criminal charge of fraud against him and his company at this time.  I'm looking for representation from an attorney to assist me in recovering the $800.00 plus any fees for court filing and attorney representation.

John McCarten and his company JMC Swingarms is not to be trusted in a way.  He is a fraud and a thief.  I'm extremely frustrated with the whole situation and need help.  I'm going to attempt to reclaim the money by contacting my credit card company and have them retrieve the funds but I truely want to file charges for fraud against him.  I would appreciate consultation and assistance from an attorney.

First off, this isn't a 'bash' but an account of what happened. hopefully i can save some of you some grief in the future.

late sept 08, i ordered a swingarm from jmc for my rd. payment cleared oct 2, 2008, and i paid all of it up front.

they listed a 12 week lead time..

so, mos go by, no word. come jan 20th i inquire, they say it will ship next week. a few weeks later, thanks to RB, i find out they lost the sole supplier of the metal they use for the axles.

John dares me to find a metal supplier for axles, which i did. aisi4037 is a suitable replacement for en16-t metal, and let him to a supplier that had it. he also, sent to me, in writing, that i would get my arm, for FREE if i found such a supplier. i told him if he sent me my arm w/out the axle in the next week i would be happy and pay for it in full, even without the axle. Just please ship it.
2-3 Weeks more go by, they dont answer the phone, and the only time they ever answer an e-mail is when you get kind of nasty, telling me they DO read them but choose to ignore them.
well, last week I had enough and I called my bank, got a full refund against them as a fraudulent charge as it was about twice as long as they had initially projected. i could not contact them (jmc) by phone, i tried a LOT (i now know the int code for england and liverpool by heart), the BANK couldn't get a hold of them either.

I printed all my emails, presented them to my bank, and they agreed and honored my request, full refund in my account.
apparently this got their attention as 4 days after the money was in my account, i get a smug email from john mccarten that my arm was ready to ship. i informed him that i had received my refund and was not going to authorise any more charges from jmc. i also said that if they were indeed using the metal supplier i found them or any of the info therof, they owed me my arm for free and i would pay shipping. if not, so be it.

We had fallen behind on answering emails, have you tried picking up the
phone, we answer every phone-call. We don't have any dedicated office staff,
preferring to have engineers rather than secretaries.

The swingarm is here ready to ship, you did not find a steel supplier as
they only offered EN1T which has a lower tensile strength than 'bright-mild'
steel.

We have found a steel supplier for 11/16" EN16T steel and had this ground
down to 17mm.

Unless I hear from you in the next 24 hours I will assume the order
cancelled and sell the swingarm. You will have waited 24 weeks and ended up
with nothing but that's your prerogative.
