A Moreno Valley man was killed Thursday, July 12, when his motorcycle was struck by a pickup that turned in front of him on Pigeon Pass Road in Moreno Valley, the Highway Patrol reported.

The driver of the pickup, Juan Tzun Lopez, 24, of Riverside, is being investigated for vehicular manslaughter without negligence, said Officer Steve Carapia, spokesman for the CHP’s Riverside office. Lopez is not licensed to drive, Carapia said.

The Riverside County coroner’s office has identified the dead motorcyclist as Dominic Durden, 30. According to the coroner’s website, Durden was wearing a helmet at the time of the collision.

Isn't law peculiar?
Who's have thought it's NOT negligent to drive without a license??

Technically if the truck turned in front of the motorcyclist, the motorcyclist struck the truck.

Reminds me of this story I heard about today:  The SUV did it!

Reader's Digest:  Out of control vehicle runs well off the road, hits a fire hydrant then careens into a high school student, killing her.  The driver is an illegal alien, no license, with past convictions for drunk driving and driving without a license (and of course no deportation action was ever taken...).  The media take on it?

"St. Paul teen killed by SUV remembered at her funeral.”

Illegal immigrant?

Probably. Contrary to what some believe, CA doesn't issue licenses to the undocumented.

God bless the Comonwealth.

No, a few years ago the Guvernator suggested giving out licenses to people without papers. It fell through but they caught a lot of illegals who couldn't read English who thought it had passed and had marched into the DMV. My local DMV told them all to come back on a specific date. Whoever showed up was ushered into a side office where they were met by la Migra. DOH!

So Dominic Durden was a legal resident?

We love to rush to blame without knowing all the facts. Not that immigration status of either one really has a bearing on the wreck with regards to the shitty link Giaka posted. Not newsworthy.

If he wasn't a legal resident he was certainly very cocky in choosing his career.

You actually believe a county employee can't be an illegal resident?

"can't" is improbable

On the other hand, an illegal immigrant working as a sheriff's dispatcher seems a little improbable as well.

However if anyone can produce evidence of illegal immigrants working as clerical staff etc. for the police I am open to the theoretical possibility.

I would guess that in those instances, however, very few of their parents create a scholarship or bursary in their name immediately following their child's death.  It's certainly a lot of attention to willfully attract if you're not even allowed to be in the country.

While I'm of mixed thoughts on this type of "accident", the fact that one party was unlicensed, IMO, should make that person automatically guilty.

this is how it works, any accident is simply and accident if the driver is properly licensed and not DUI. If not, then he/she gets to go to jail...

I wish that were uniform. As I understand it, and as extreme example, in Maryland for example, I could turn left in front of a speeding, unlicensed, uninsured, illegal immigrant driving a stolen car, and if I violated his right of way, I'm the one to blame, end of story.
